1. About These Terms
These Terms of Service ("Terms") govern your use of the Nerano online store and the purchase of products through our website. By accessing our store or placing an order, you agree to be bound by these Terms.
Nerano is a proprietary limited company registered in Australia (Pty Ltd). These Terms are governed by the laws of New South Wales, Australia.
We reserve the right to update these Terms at any time. Changes will be posted on this page with a revised date. Continued use of our store after any changes constitutes your acceptance of the updated Terms.
2. Eligibility
By using our store, you confirm that you are at least 18 years of age, or are accessing the store with the consent and supervision of a parent or guardian. You also confirm that you have the legal capacity to enter into a binding agreement.
3. Products
We take care to accurately represent our products, including descriptions, imagery, and pricing. However, we do not warrant that product descriptions or other content are error-free, complete, or current. If a product you receive differs materially from its description, please contact us.
All products are subject to availability. We reserve the right to limit quantities, discontinue products, or refuse orders at our discretion.
4. Pricing & Payment
All prices are listed in Australian Dollars (AUD) and include GST where applicable. We reserve the right to change prices at any time without notice. The price applicable to your order is the price displayed at the time of checkout.
Payment must be made in full at the time of purchase. We accept payment via the methods listed at checkout. All transactions are processed securely through our payment provider — we do not store your full payment details.
5. Orders & Acceptance
Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion. An order is confirmed when you receive an order confirmation email from us.
We reserve the right to cancel an order if a product is out of stock, if there is an error in pricing or product information, or if we suspect fraudulent activity. In such cases, you will be notified promptly and any payment received will be refunded in full.
6. Shipping & Delivery
We ship within Australia via Australia Post. Estimated delivery timeframes are provided at checkout and are indicative only — we are not liable for delays caused by third-party carriers or circumstances outside our control. Risk of loss and title for products passes to you upon dispatch. If your order is lost or damaged in transit, please contact us and we will work with you to resolve the issue.
7. Returns & Refunds
Our returns and refund policy is set out in our separate Refund & Return Policy, which forms part of these Terms. Your rights under the Australian Consumer Law are not affected by our policy.
Under the Australian Consumer Law, you are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
8. Wholesale & Trade Orders
If you are purchasing as a wholesale or trade customer, the following additional terms apply:
- Wholesale pricing and minimum order quantities are agreed separately and confirmed in writing prior to order placement.
- Wholesale orders are subject to the same payment, shipping, and returns terms as retail orders unless otherwise agreed in writing.
- Wholesale customers are responsible for ensuring products are stored, handled, and resold in accordance with any care or safety guidelines provided by Nerano.
- Nerano reserves the right to withdraw wholesale access at any time, including where products are resold in a manner inconsistent with our brand standards.
- Wholesale pricing and terms are confidential and must not be disclosed to third parties.
9. Intellectual Property
All content on our store — including product names, descriptions, photography, branding, and design — is the property of Nerano and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.
10. Limitation of Liability
To the fullest extent permitted by law, Nerano's liability for any claim arising from your use of our store or purchase of our products is limited to the amount paid for the relevant order. We are not liable for any indirect, incidental, or consequential loss or damage.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.
11. Privacy
Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms. By using our store, you consent to the collection and use of your information as described in that policy.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of our store will be subject to the exclusive jurisdiction of the courts of New South Wales.
